Abstract

This article is titled "Circulation of Copyright Royalties and Their Problems." The focus of the research is first on theories related to licensing, royalty and copyright. Second, civil copyright issues such as reduced copyright royalties for creators due to commercialization. This research is with a qualitative method. Using juridical, legislative, and historical approaches. The primary data source is Decision No. 92/Pdt-Sus-HKI/Copyright/2024/PN Niaga, JKTPs and Law Number 28 of 2014 concerning Copyright. Secondary data is in the form of books, journals and other laws. The analysis procedure of this research is as follows: First, copyright, license and royalty. Second, Agnes Monika Mulyoto in copyright cases. Third, the optimization of Collective Management Institutions (MFIs) and the transformation of copyright rules globally. The results of the research show, first the theory is related to licenses, royalties and copyrights. Second, the analysis of copyright infringement cases from the civil review. There is a direct violation of copyright that causes losses to the creator. As a result, the Creator loses economic rights from commercialization without the creator's license or permission. The creator's royalty money is reduced. Case in point: A song titled "Say Saja" has become a major case in Indonesia in 2024. The creator does not get royalties from the song "Say Only". The song that became the case was sung again by Agnes Monika Muljoto in several activities in several places for 3 days. The songwriter then filed a civil lawsuit with the Commercial Court. The trial was won by the plaintiff and Agnes Monika Mulyoto as the defendant must pay losses of around Rp 1,500,000,000 (one billion five hundred million rupiah) as stated in the decision No. 92/Pdt-Sus-HKI/Copyright/2024/PN Niaga, JKTPst.
